⚖️🚨 Affaire Boko et Homéky : L’avocat de Olivier Boko dénonce de graves irrégularités et des vices insurmontables     

L’affaire du supposé Coup d’Etat impliquant Olivier Boko et Oswald Homéky , suscite désormais de vives critiques à l’encontre du système judiciaire béninois. Alors que l’instruction menée par la Cour de répression des infractions économiques et du terrorisme (CRIET) a pris fin, des accusations de graves irrégularités ont été portées par les avocats de la défense. Me Ayodele Ahounou, avocat d’Olivier Boko, a dénoncé des « vices   » dans la procédure judiciaire, remettant en question le respect des droits fondamentaux des accusés.

Des vices de procédure flagrants 📂❌

Parmi les manquements soulignés, l’avocat a pointé du doigt : La non-transmission conforme des dossiers d’instruction . Il explique que les documents transmis aux avocats de la défense ne correspondraient pas au dossier détenu par les magistrats, empêchant une défense efficace. Par ailleurs, l’omission d’inviter tous les avocats de la défense constitue également une violation directe des règles de procédure qui garantit à chaque accusé un accès équitable à la justice. Maitre Ayodélé a noté enfin  le refus de transmettre une exception d’inconstitutionnalité à la Cour constitutionnelle, conformément au code de procédure pénale.  

Une justice expéditive et contestée ⏳

La célérité suspecte avec laquelle la CRIET a rendu ses décisions interroge. Pour Me Ahounou, les magistrats n’étaient soumis à aucune contrainte temporelle, ce qui aurait permis une analyse plus approfondie des nombreuses irrégularités signalées. Selon lui, cette approche remet en question la quête de vérité et l’impartialité de l’institution judiciaire.

Un impact sur la confiance dans la justice 🇧🇯🤔

L’affaire Boko et Homéky est devenue un symbole de la fragilité du respect des droits de la défense au Bénin. Ces révélations mettent en lumière des pratiques judiciaires qui minent la crédibilité des institutions et alimentent la défiance des citoyens envers la justice. « Lorsque la racine pourrit, la plante doit mourir », a conclu Me Ahounou, en référence à l’inadéquation de la procédure pour garantir un jugement équitable. Face à ces critiques, l’opinion publique et les observateurs internationaux s’interrogent sur l’indépendance et l’équité du système judiciaire béninois. Tandis que la procédure suit son cours, cette affaire reste un test crucial pour la solidité de l’État de droit au Bénin.
