L’affaire Olivier Boko, impliquant l’un des plus proches conseillers du président béninois Patrice Talon, continue de captiver l’attention. Alors que la justice semble précipitée pour conclure l’instruction, Maître Paul Kato Atita, avocat nouvellement intégré à la défense, éclaire sur les trois issues possibles qui pourraient découler de cette procédure judiciaire. Ces scénarios, issus des pratiques courantes de droit pénal, traduisent les multiples facettes de l’enquête en cours.

Le non-lieu : une éventualité d’abandon

La première possibilité évoquée par Me Paul Kato Atita est celle du non-lieu. Une telle décision signifierait que le juge ou la commission d’instruction n’a pas trouvé suffisamment de charges pour poursuivre un ou plusieurs accusés. “Le non-lieu peut concerner l’ensemble des inculpés, certains d’entre eux, ou une seule personne”, précise l’avocat. Cette issue, bien qu’envisageable, pourrait provoquer des remous, notamment au regard de la dimension sociopolitique de l’affaire. Un non-lieu pourrait être interprété comme un acte d’apaisement ou, à l’inverse, comme une manière d’éviter de creuser davantage dans des zones d’ombre gênantes.

Renvoi en jugement : L’option d’une confrontation judiciaire

La seconde issue probable est le renvoi devant la juridiction de jugement, où les accusations portées contre certains inculpés seraient jugées suffisamment solides pour passer à la phase de procès. Dans ce cas, les accusés seraient officiellement traduits devant un tribunal de jugement, et leur culpabilité ou leur innocence serait déterminée après un débat contradictoire. Selon Me Atita, cette option reflète l’objectif traditionnel de la justice dans des affaires aussi graves. Cependant, il insiste sur le besoin d’un procès équitable, basé sur une instruction équilibrée à charge et à décharge. “Pour garantir un jugement impartial, il est crucial que tous les acteurs clés, y compris le chef de l’État, soient entendus”, souligne-t-il.

Requalification des charges : une redéfinition des accusations

Enfin, Me Paul Kato Atita évoque la possibilité d’une disqualification ou requalification des chefs d’accusation. Ce scénario permettrait de modifier ou d’ajouter de nouvelles charges en fonction des preuves recueillies au cours de l’enquête. “Les chefs de poursuite initiaux peuvent être ajustés pour refléter de nouvelles interprétations des faits”, explique l’avocat. Par exemple, des accusations d’atteinte à la sûreté de l’État pourraient être transformées ou complétées par des infractions d’une autre nature. Cette démarche, bien que légale, peut parfois soulever des doutes quant à la cohérence et à l’équilibre de l’instruction.

Un Procès Équitable en Jeu

Quel que soit le scénario retenu, Maître Kato Atita insiste sur l’importance de respecter les droits des accusés et de garantir un procès équitable. “Une justice précipitée risque d’entacher la crédibilité des institutions judiciaires béninoises”, avertit-il. Alors que le dossier semble avancer à une vitesse inhabituelle, les trois issues possibles – le non-lieu, le renvoi en jugement, ou la requalification des charges – seront scrutées avec attention par l’opinion publique et les observateurs internationaux. La quête de vérité et de justice dans l’affaire Olivier Boko ne fait que commencer.
